Procurement rules and information

General Information

The Europe’s Rail (EU-Rail) Joint Undertaking is subject to the provisions of its Financial Rules. In accordance with Council Regulation (EU) 2021/2085 EU-RAIL is the legal and universal successor of the former Shift2Rail Joint Undertaking (S2R JU), which it replaced and succeeded. Therefore references to S2R JU in the Financial rules shall be construed as references to EU-RAIL.

In accordance with Article 33 of the EU-RAIL Financial Rules, as regards of procurement, Title VII of the EU Financial Regulation  (Regulation (EU, Euratom) 2024/2509 and Annex I to this Regulation apply.

The time limit to lodge an appeal is within 2 months of notification on non-award.

European Ombudsman

The European Ombudsman investigates complaints about maladministration in the institutions and bodies of the European Union.
If you believe that there was maladministration in a procurement procedure, you may lodge a complaint to the European Ombudsman (see https://www.ombudsman.europa.eu) within two years of the date when you became aware of the facts on which the complaint is based.

Data protection

Regulation (EU) 2018/1725 of 23 October 2018 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data, and repealing Regulation (EC) No 45/2001 and Decision No 1247/2002/EC  applies to the processing of personal data carried out by EU-RAIL.
